Pre-authentication Required for International Commercial Documents

In order for commercial documents to be considered valid for international use, they must first go through a process of pre-authentication by the corresponding Chamber of Commerce. Only then will they be accepted for attestation by the Ministry of External Affairs.

Apostille:     As a member of the Hague Convention of October 5, 1961, India is able to provide an alternative form of legalisation for personal and educational documents, known as an Apostille. This is recognized by 98 member-countries of the Convention, and can be applied to documents such as birth and marriage certificates, diplomas, degree certificates, Affidavits, Power of Attorney, and more. By visiting the Hague Conference on Private International Law website (www.hcch.net), you can access a list of member countries that accept the Apostille, eliminating the need for traditional legalization of foreign public documents.

MEA Attestation: Required Documents for Educational/Personal Certificates

The Ministry of External Affairs (MOFA) can only provide an Apostille for original documents that have been authenticated by designated authorities of the State Governments. The Apostille is placed on the reverse side of the original document. To apply, the following documents and fees are required:

  • the original document to be attested or apostilled
  • a clear photocopy of the document
  • a clear photocopy of the passport

These documents can be submitted in person or through an authorized representative at the MOFA’s “Collection & Delivery” counters from 09:00 to 18:00 from Monday to Saturday, excluding holidays. The documents will be returned upon production of the receipt for payment of service charge. However, If the document is found to be fake or the authentication is forged, it will be seized by the MOFA and appropriate legal action may be taken against the applicant. The service charge paid to the MOFA is non-refundable in any circumstance.

Note: It is important to note that before submitting any document to the Ministry of External Affairs (MOFA) for attestation, it must first be pre-authenticated by the appropriate authorities such as the HRD/HD and MEA. This step is mandatory and must be completed before the document can be accepted for MOFA attestation.
